OutSavvy Ltd (we) are committed to protecting and respecting the privacy of both our customers and event organisers (you).
This is the privacy policy (Privacy Policy) for www.outsavvy.com and the OutSavvy application. For the purposes of this Privacy Policy, both the OutSavvy website and application shall be referred to as the "App". This Privacy Policy (together with our ‘Terms and Conditions for Event Organisers’ and our ‘Terms and Conditions for Customers’) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
By using the App, you consent to the collection and use of information in accordance with this Privacy Policy.
For the purpose of the Data Protection Act 2018 (Act), the data controller is OutSavvy Ltd of 85 Great Portland Street, London, W1W 7LT.
INFORMATION WE MAY COLLECT FROM YOU
We may collect and process the following data about you:
- Information you give us. You may give us information about you by filling in forms on the App or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you register to use the App, uploading information in order to sell tickets to new events or buy tickets to existing events, participate in discussion boards or other social media functions on the App, enter a competition, promotion or survey, and when you report a problem with the App.
- The information you give us may include your name, address, e-mail address and phone number as well as financial and credit card information.
- Information we collect about you. With regard to each of your visits to the App we may automatically collect the following information:
- technical information, including the Internet protocol (IP) address used to connect to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
- your preferences (to enable us to provide more tailored offers to you) and details of your visits to the App, the resources you access and any data you download; and
- the type of phone or operating system you use and, if you came to the website, the type of internet browser you use and the website from which you have come to the site. Also, depending on whether you access OutSavvy on your PC or via your mobile device, we will collect your IP address (the unique address which identifies your home computer on the internet) or the unique identifier (which is linked to your mobile device) which are automatically recognised by our servers. You cannot be identified solely from this information and it is only used to assist us in providing an effective service on the App and to collect broad demographic information for aggregate use.
- Information we receive from other sources. We may receive information about you if you use any of the other websites that we operate or the other services we provide. We are also working closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.
COOKIES
The App may use cookies to distinguish you from other users of the App. Cookies are pieces of information that a website transfers to your hard drive to store and sometimes track information about you. This helps us to provide you with a good experience when you use the App and also allows us to improve the App.
USES MADE OF THE INFORMATION
We use information held about you in the following ways:
- Information you give to us. We will use this information:
- to carry out our obligations arising from any contracts entered into between you and us and to provide you with the information and services that you request from us;
- to notify you about changes to our service; and
- to ensure that content from the App is presented in the most effective manner for you and for your computer.
- How we use your information
1. Order and payment processing, customer service and quality assurance
- We use contact information to help us efficiently perform transactions to deliver the services you have requested and to perform quality assurance, sales analysis and other business analyses.
- We may also provide your contact information to your credit card issuer or to credit processors for their purposes. When you make a purchase through the App, or register with the App, you will provide us with an email address where we, or the service providers, may contact you for the purposes described in this paragraph.
2. Providing event organisers with contact information
- Subject to the above, when you use the App to purchase tickets, you expressly consent for us to provide your email address and other summary contact and payment information to the event organisers for your selected event. This information is provided to the event organiser to enable them to contact you as and when necessary regarding your purchase and also for facilitating dispute resolution, customer service and notification of any amendments or cancellation of the event.
3. Contacting you with offers and promotions
- After you provide us with your contact details in connection with ordering tickets you will be given the opportunity to specify how that data is handled. You can request that:
i. your email address and other contact details be added to the event organiser's database and used to send you information on forthcoming events by this event organiser only; or
ii. your details are forwarded to other event organisers in your area that use OutSavvy and used to send you general event information.
- By selecting any of these options you agree that OutSavvy (on behalf of itself or other organisations) may send to your nominated email address such promotional emails whose content falls within the description/s you have selected, until such time that you indicate a preference not to receive them.
- If you have not opted to receive any category of promotional email, then we will not share your contact information with any third parties other than any event organiser from whom you actually purchase, and then only to the extent and for the purposes permitted by this Privacy Policy.
4. How we use financial information
- We use your financial information to help us efficiently perform sales and other transactions on the App in order to deliver the services you have requested and to perform quality assurance checks. In some cases we may use third party service providers to help us perform some of these tasks (e.g. Merchant Service Providers) and consequently we may provide them with your financial information. In such cases, we will require these service providers to enter into agreements with us regarding the confidential handling of your information.
- Information we receive from other sources. We may combine this information with information you give to us and information we collect about you. We may us this information and the combined information for the purposes set out above (depending on the types of information we receive).
DISCLOSURE OF YOUR INFORMATION
As permitted above, we may share your information with selected third parties including:
- Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you.
- Our payment providers Braintree and Square Payments
- Advertisers and advertising networks that require the data to select and serve relevant adverts to you and others.
- Analytics and search engine providers that assist us in the improvement and optimisation of the App.
- Facebook and other third party connections. You can connect your OutSavvy account to your accounts on third party services like Facebook, in which case we may collect, use, disclose, transfer and store/retain information relating to your account with such third party services in accordance with this Privacy Policy
As your data processor we use a number sub-processors to provide our services. Details of the sub-processors we use with regards to your data are listed below. All sub-processors have been verified as either GDPR compliant or committed to being GDPR compliant by the 25th May 2018.
- Amazon Web Services - we use Amazon web services to send event communication from the OutSavvy platform
- Mail Chimp - we store your name and email address on the Mail Chimp servers to send out our weekly newsletter
- Tagadab - provide us with our hosting, database, and backup infrastructure. Our web servers are based in the UK
We may disclose your personal information to third parties:
- In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
- If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our or terms and conditions of supply and other agreements; or to protect the rights, property, or safety of OutSavvy Ltd, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
WHERE WE STORE YOUR PERSONAL DATA
The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the App; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
YOUR RIGHTS
You have the right to ask us not to process your personal data for marketing purposes. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data. You can also exercise the right at any time by contacting us at admin@outsavvy.com.
The App may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.
CHILDREN'S ONLINE PRIVACY PROTECTION ACT
We do not knowingly collect Personal Data from children under the age of thirteen (13). If you are under the age of thirteen (13), please do not submit any Personal Data through the app
ACCESS TO INFORMATION
The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act.
THE EU GENERAL DATA PROTECTION REGULATION (GDPR)
In May 2018, a new data privacy law known as the EU General Data Protection Regulation (or the "GDPR") becomes effective. The GDPR requires OutSavvy and Partners using the Service to provide Customers with more information about the processing of their Personal Data.
The GDPR requires that we inform you of the legal ground we are relying on to process your data. We process and store data about you because:
- you as a customer provided consent
- it is necessary for our contractual relationship as a ticketing platform
- it is required to protect the security and integrity of our systems and to provide you with customer service
Your data protection rights - Data protection law provides you with rights in respect of Personal Data that we hold about you, including the right to request a copy of the Personal Data, request that we rectify, restrict or delete your Personal Data, object to profiling and unsubscribe from marketing communications. You can set your privacy settings in the My Profile account section and also delete your account. If you require further access of data please contact OutSavvy.
If you have a complaint about how we handle your data, please get in touch with OutSavvy. If you are not happy with how we have attempted to resolve your complaint, you may contact the relevant data protection authority.
EU data protection law makes a distinction between organisations that process personal data for their own purposes, data controllers, and organisations that process personal data on behalf of other organisations, data processors. OutSavvy may act as either a data controller or a data processor in respect of your personal data, depending on the circumstances.
If you create an account with OutSavvy to create events and sell tickets, we act as a data controller in respect to the personal data you provide. If you register for an event as a customer, we will process personal data to help administer that event on behalf of the event organiser. OutSavvy provides tools for our partners to contact their customers. Any questions that you may have relating to your personal sata and your rights under data protection law should therefore be directed to the event partner as the data controller, not to OutSavvy.
