These terms and conditions (Terms) set out the basis on which you, the customer (Customer), may make use of the OutSavvy website (www.outsavvy.com) and the OutSavvy application to purchase tickets for organised events directly from event organisers. For the purposes of these Terms, both the website and application shall be referred to as the “App”. OutSavvy is the trading name of OutSavvy Ltd of 85 Great Portland Street, London, W1W 7LT (registered under company number 08664328).
To use the App and to book tickets to any events you must be 16 years or over (but please be aware of the age restrictions that maybe applicable to any specific event). By continuing to use the App, you represent that you are 16 years or over and you expressly agree to be bound by these Terms and to follow all applicable laws and regulations governing the App. OutSavvy reserves the right, at its sole discretion, to change these Terms at any time, effective immediately upon posting on the App so please check the App regularly for any updates. If you violate these Terms, OutSavvy may terminate your use of OutSavvy’s services, bar you from future use of the App and/or take appropriate legal action against you.
1. Who we are
OutSavvy enables event organisers to sell tickets to their events directly to Customers via the App. We do not sell tickets on behalf of the event organisers and therefore the contract of sale is between you and the event organisers.
2. Permitted uses of the App
You may only use the App for non-commercial, lawful purposes and only in accordance with these Terms. You are not permitted to remove or change any content on the App or interfere with the working of the App.
3. Intellectual property rights
All intellectual property rights (which includes rights such as copyright, and rights in trade marks) in any content of the App (including text, graphics, software, photographs and other images, videos, sound, trade marks and logos) are owned by OutSavvy and/or its licensors.
Except as expressly set out in these Terms, nothing in these Terms gives you any rights in respect of any intellectual property owned by OutSavvy or its licensors and you acknowledge that you do not acquire any ownership rights by downloading content from the App. If you print off, copy or store pages from the App (only as permitted by these Terms), you must ensure that any copyright, trade mark or other intellectual property right notices contained in the original content are reproduced.
You agree that by submitting any posting, images or other content for publication on the App (“your content”), you retain any copyright you may have in your content; however you grant OutSavvy and its affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, edit, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or in part) and/or to incorporate it into other works in any form, media or technology, whether for commercial or non-commercial purposes. You waive any moral rights you may have in, or to be identified as the author, of your content.
You are solely responsible for your content (including content you share with other sites, such as social networking sites) and OutSavvy does not endorse your content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with your content.
4. Service access
While OutSavvy endeavours to ensure that the App is normally available 24 hours a day, OutSavvy shall not be liable if for any reason the App is unavailable at any time or for any period.
Access to the App may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
5. Registration and security
During the OutSavvy registration process, a unique account and password will be created. It is your responsibility to maintain the confidentiality of your password and account information and you are fully responsible for all activities that occur under your account.
You must immediately notify OutSavvy of any unauthorised use of your password or account or any breach of security. OutSavvy cannot and will not be liable for any loss, damage or other liability arising from your failure to comply with this section 5 or from any unauthorised access to or use of your account.
You are permitted to have only one account registered in your name. Registering more than one account is a breach of these Terms and your account(s) may be terminated with all applicable credit on the account lost.
6. Purchasing tickets
OutSavvy merely facilitates the transaction between event organisers and Customers. OutSavvy does not set ticket prices or determine availability or location of seating. OutSavvy simply handles the booking process and collection of payments on behalf of event organisers when you purchase tickets online via the App. This means that the contract for the ticket purchase is between you and the event organiser. We may, therefore, pass essential booking details to the relevant event organiser. The placing of an order to purchase tickets will constitute consent to our passing on your details for this purpose.
When purchasing tickets for events via the App you may get the opportunity to specify:
a) the venue section or price category in which you wish to buy tickets;
b) the quantity of tickets you wish to buy; or
c) where relevant, the position of seats.
The App will then display the payment due for the tickets specified. You will then be asked to select a preferred method of payment and having entered and submitted credit or debit card details, the OutSavvy system will charge the card issuer the appropriate amount. On completion of the transaction, the chosen tickets will be registered in your name and you will be sent confirmation of purchase with your unique ticket ID.
Payment for tickets will only be accepted in British pounds.
5.1 Order Confirmation
Order confirmation will take the form of a summary web page or app download at the end of the purchase sequence which will be followed by a confirmation email. Both contain details of the tickets purchased and a unique purchase reference number, which acts as your proof of payment.
Tickets cannot be sold or exchanged to any other persons and you may be asked to produce identification confirming that you are the person identified on the ticket.
5.2 Dispatch of tickets
Following confirmation of your purchase, you will be given the option to either download your ticket(s) to print yourself at home or download the ticket(s) to the OutSavvy app.
7. Exchanges and refunds
By default tickets purchased on OutSavvy are non-refundable. Event organisers may have varying exchange and refund policies set forth by our event organisers, please see the event for more details. If you require an exchange or refund, please contact the event organiser directly using the Contact Organiser form. OutSavvy only refunds booking fees for cancelled events otherwise only the original ticket price is refunded.
8. Cancellation of an event
Where OutSavvy has been notified by the event organiser of an event cancellation, OutSavvy will use its best endeavours to contact you by email (using the details provided at the time of booking) advising you of the cancellation and initiating the refund process between you and the event organiser.
9. Event postponed or change of venue
Where OutSavvy has been notified by the event organiser an event postponement or venue change, OutSavvy will use its best endeavours to contact you by email (using the details provided at the time of booking) advising you of the postponement or venue change and asking you to contact the event organiser for further information.
10. Pricing errors
If the amount paid for a ticket sold through OutSavvy is grossly incorrect, regardless of how the error occurred, OutSavvy may cancel that ticket (or the order for that ticket) and refund any sum you have paid.
11. Price
The price of tickets is as quoted on the App from time to time. Prices include VAT, booking and credit card fees, if applicable.
Prices are liable to change at any time, but changes will not affect ticket purchases in respect of which we have already sent you an email confirmation.
12. Event organiser’s terms and conditions
Tickets are sold subject to these Terms as well as any applicable individual event or venue’s own terms and conditions, including age restrictions, refund and exchange policy. If an event or venue has its own terms and conditions, they will be provided to you before the point of your purchase.
Please read the applicable event organiser’s and/ or venue’s terms and conditions before purchasing any tickets.
Please be aware that you maybe refused entry to an event if you are deemed to be drunk or intoxicated in any way and will have no right to a refund.
13. Your data
In respect of any personal data (as defined in the Data Protection Act 2018 (Act)) the event organiser is responsible to ensure that they comply with the Act and continue to comply with any future amendments to the Act and any guidance by the Information Commission.
By purchasing a ticket, you agree that OutSavvy will share your data as provided to the event organiser who can use the data to facilitate organisation of the event.
Subject to all applicable data protection legislation and the terms of our Privacy Policy, your personal data generated in connection to your purchase of tickets via the App shall be owned jointly by OutSavvy and the event organiser and/or their organisation and, subject to any relevant consents being granted by you under the Act, each party shall be entitled to use your data to facilitate the ticketing service.
14. Warranties
The App and its content are delivered on an “as-is” and “as-available” basis.
OutSavvy does not guarantee that the App will be error-free, uninterrupted, or that it will provide specific results from any content, search or link on it.
OutSavvy cannot ensure that files you download from the App will be free of viruses or contamination or destructive features.
15. Limitation of liability
This clause 15 sets out OutSavvy’s entire liability to you under or in connection with this agreement.
Nothing in these Terms limits or excludes OutSavvy’s liability for:
- death or personal injury caused by its negligence; or
- fraud or fraudulent misrepresentation.
Subject to the above, OutSavvy will not have any liability to you under or in connection with this agreement for any:
- loss of profits or account of profits;
- loss of sales or business;
- loss of agreements or contracts;
- loss of opportunity;
- loss of anticipated savings;
- loss of or damage to goodwill;
- loss of use or corruption of data or information; or
- any indirect or consequential loss.
Subject to the above, OutSavvy’s total liability to you under or in connection with these Terms will be limited, in respect of all claims (connected or unconnected) in any consecutive 12 month period, to an amount equal to the total sum of money paid by you via the App in that period.
15.1 Covid 19
‘Covid-19’ means: the global outbreak of the respiratory coronavirus disease known as COVID-19 and the virus known as severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) (and any subsequent waves or derivatives of the same). There is a risk of the transmission of Covid-19 in any environment where people come together, which is increased in enclosed spaces with an increased number of people.
By purchasing tickets to an event via the App, you accept that neither OutSavvy nor the Event Partner can guarantee that you will not be exposed to Covid-19. You voluntarily accept the risk of being exposed to, contracting or spreading Covid-19. You agree that OutSavvy and the Event Partner are not responsible or liable for any injuries, sickness, or death resulting from such causes.
You agree to:
- To comply with all health and safety protocols implemented by the Event Partner (which can be amended at any time according to the latest guidance or legislation, or as otherwise deemed necessary). These protocols may be communicated to you via various channels including but not limited to the Event Partners website, venue signage, the OutSavvy event listing or as instructed by venue staff at the event;
- To abide by all current and relevant government guidance aimed at preventing the transmission of Covid-19; and
- Not to enter the venue or event if you believe you may have been infected with Covid-19.

17. Applicable law and jurisdiction
These Terms are governed by English law and you agree that the courts of England shall have exclusive jurisdiction over any dispute or claim that arises out of or in connection with these Terms.
18. OutSavvy Payment Plan
Certain events on OutSavvy can be bought using a Payment Plan that allows eligible customers to pay for tickets with an initial deposit and either one final payment or a split of the balance over a number of payments (each an Instalment).
By selecting the Payment Plan option, you unconditionally agree to pay the total Ticket price via the agreed number of Instalments, and by the deadlines specified within the Payment Plan.
By making payment of the first Instalment of the Payment Plan, you agree that you are entering into a contract to purchase the Ticket and pay the total Ticket price.
The Payment Plan will grant you a conditional right to receive a Ticket following successful payment of all Instalments.
The payment of an Instalment of the Payment Plan does not guarantee the reservation of a Ticket until the total Ticket amount has been paid.
OutSavvy recommends that you add a card for autopayment of remaining Instalments. It is recommended that you ensure that adequate funds are in place to process the payment of all Instalments on the dates set out in your Payment Plan confirmation screen and that your credit or debit card does not expire before the final Instalment can be charged.
Once all Instalments have been paid on or before their respective deadlines, the Tickets will be sent to you via email and will be available on the OutSavvy website and app.
The first Instalment known as the Deposit is non-refundable and no claim can be made to recover this money in any way whatsoever unless the event is cancelled.
OutSavvy’s Ticket Resell feature (if applicable) will not be available until all Instalments of the Payment Plan have been made.
18.1 Failure to pay Instalment
If you do not pay any of the Instalments in full, you will lose the deposit, fees and the Ticket(s)
If for any reason, OutSavvy is unsuccessful in obtaining an Instalment by the payment date, a payment request will be sent to you through which the Instalment must be paid manually within 2 days.
Failure to pay the Instalment for a second time will result in the purchase being cancelled.
OutSavvy will then notify you that due to an Instalment not being made, your Ticket purchase is cancelled.
OutSavvy will not attempt to take any future instalment payments, and you will not be entitled to a Ticket for the Event.
